Terms of Service

These terms define the rules for using FiveGuard, placing orders and purchasing digital services.

§1 Parties to the transaction

1. Owner of the website available at https://fiveguard.net (the “Service”) is Digital Goods LLC, registered at 810 Pony Express Rd, Cheyenne, WY 82009 USA, under registration number 2023-001220535 (the “Provider”).

2. The Service allows purchase of digital services related to online games, especially anticheat access, license keys and software subscriptions (the “Services”).

3. This document defines the rules for using the Service, placing orders and rights and obligations of both parties of the digital service agreement.

4. By using the Service, the user (the “User”) confirms that they have read and accepted these Terms.

5. Matters not covered by this document are governed by the law of the Provider's jurisdiction. Consumer rights under local law remain unaffected.

§2 Nature of services

1. All Services offered through the Service are digital and delivered immediately after payment, electronically or through activation on the User's system account.

2. The Provider does not sell physical products.

3. Descriptions and prices of Services published on the Service are an invitation to conclude an agreement, not a legal offer.

§3 Orders and payments

1. Orders can be placed through the Service.

2. The User selects a Service, payment method and provides required information, such as e-mail.

3. Payments are processed via external payment operators.

4. The agreement is concluded once payment is received by the Provider.

5. After payment confirmation, the order is processed automatically or manually within 24 hours.

§4 Delivery of services

1. Services are delivered according to their description on the Service.

2. If technical issues prevent delivery, the Provider informs the User and offers extension of delivery time or a refund.

3. The User is responsible for providing correct information, such as account ID or e-mail.

§5 Right of withdrawal

1. Due to the nature of digital content delivered instantly, the right of withdrawal does not apply once the Service has started with the User's consent before 14 days.

2. An exception applies if the Provider fails to deliver the Service as described. In that case, the User may request a refund.

§6 Complaints

1. Complaints can be sent to [email protected].

2. A complaint should include name, order number, description of the issue and preferred resolution.

3. The Provider reviews complaints within 14 business days.

4. If accepted, the Provider may restore or reactivate the Service, replace it with an equivalent service or refund payment.

§7 Liability

1. The Provider is not liable for errors caused by third-party software, loss of access to an account on a platform or damage caused by violation of game or platform rules.

2. The User agrees not to use the Service for unlawful, unethical or unfair actions.

§8 Personal data

1. Data controller: Digital Goods LLC, based in the USA.

2. Data is processed for order handling, customer support and complaint management.

3. The User has the right to access, correct or delete their data according to applicable data protection laws.

4. Data may be shared with third parties involved in Service delivery, such as payment or technical providers.

§9 Final provisions

1. The Provider reserves the right to modify these Terms. Changes take effect once published on the Service.

2. Matters not covered are governed by the law of the Provider's jurisdiction.

3. Disputes are resolved by the court competent for the Provider's registered office, unless consumer law states otherwise.

4. Terms are effective from the publication date on the Service.
